The Licensee may use the Software subject to the following terms and conditions: c1 Evaluation (Trial) Version. The Licensee is hereby licensed to freely copy and distribute the Software by any means, provided all files and documentation are included without modification. c2 Registered Version. One registered copy may either be used by a single person on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both. This License is automatically terminated if the Licensee transfers the Software. c3 The Licensee is specifically prohibited from charging, or requesting donations for the Software and from distributing the Software and/or documentation with other products (commercial or otherwise) without prior written permission by the Vendor. 3.DISCLAIMER OF WARRANTY Although efforts have been made to assure that the Software is correct, reliable, technically accurate and will perform in accordance with the documentation, the Software is licensed to Licensee as is and without warranties as to performance, merchantability or fitness for a particular purpose or use, or any other warranties whether expressed or implied. The Vendor does not warrant that the Software will operate error free, or that any defects or errors in the Software will be corrected. Licensee, and any transferees, must assume the entire risk of using the Software. Should the Software prove defective, the Licensee and not the Vendor, shall bear the whole cost of any repairs, service, consulting, and/or correction measures. The Software is not designed or intended to be used in any activity that may cause personal injury, death or any other severe damage or loss. In no event shall the Vendor be liable for any consequential, special, incidental or indirect damages of any kind arising out of the delivery, performance or use of this Software. ANY LIABILITY OF THE VENDOR WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. 4.TERMINATION This Agreement is effective until terminated. The Licensee may terminate it at any time by destroying the Software, including all computer programs and documentation, all license codes and erasing any copies residing on computer equipment. This Agreement also will terminate if the Licensee does not comply with any terms or conditions of this Agreement. Upon such termination the Licensee agrees to destroy the Software and erase all copies residing on computer equipment.
