CaptureEze Pro Trial Version License Agreement This CaptureEze Pro Trial Version License Agreement (the "Agreement") is a legal agreement between you, the end user, and Application Techniques, Incorporated for the use of the CaptureEze Pro software and related documentation (the "Software"). Your rights to use the Software are limited by the terms and conditions of the Agreement below. The permission of Application Techniques, Inc. to install the Software is expressly conditioned on your reading and agreeing to the Agreement in its entirety before installing the Software. COPYRIGHT: The Software which accompanies this license is owned by Application Techniques, Inc. and is protected by United States copyright laws and international treaty. While Application Techniques, Inc. continues to own the Software, you will have certain rights to use the Software following your acceptance of the Agreement. Your rights and obligations with respect to the use of this Software are as follows: LIMITS OF USE: This trial version of the Software is limited to a pre-determined period of days after which it will no longer operate. Application Techniques, Inc. is the sole determinant of how many days this version of the Software will operate. The Software may be used for your personal use only, or for the purpose of evaluating the performance of the Software for a particular task. All other uses including commercial use are prohibited. GRANT OF LICENSE: You may use one copy of the Software on a single computer. You may also place the Software on a network server, provided it is used only to install or run the Software on a single computer over an internal network; you must acquire and dedicate a licensed copy of the Software for each computer that can access the Software over that network. You may physically transfer the Software from one computer to another provided that following the transfer the Software is removed from one of the computers in its entirety. You may NOT rent, lend, lease, or sublicense any portion of the Software; make copies of the documentation which accompanies the Software; translate, reverse engineer, decompile, disassemble, alter or modify the Software, or; create any derivative works based on the Software or accompanying materials. NO WARRANTIES OR LIABILITIES: The Software is provided AS IS. You expressly acknowledge and agree that use of the Software is at your own risk and that the Software is provided without any warranties whatsoever. Government Restricted Rights: The Software and documentation are provided with restricted rights. Use, duplication or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at 252.227-7013. The contractor/manufacturer of the Software and documentation thereto is Application Techniques, Incorporated, 10 Lomar Park Drive, Pepperell, Massachusetts, 01463. GOVERNING LAW: This License Agreement shall be governed by the laws of the Commonwealth of Massachusetts. ENTIRE AGREEMENT: This Agreement is the entire Agreement between Application Techniques, Inc. and you and supersedes all prior agreements, oral or written, for use of the Software. If any provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
