GENERAL: This EULA governs the use of the Software made available by or on behalf of CoffeeCup Software, Inc ("CoffeeCup", "we", "us" or "our"). For purposes of this EULA, "Software" means such application software, together with all components thereof and all updates, patches, fixes, modifications and enhancements thereto, including releases of new versions, whether provided to you via download, automatically without additional consent or action on your part or otherwise, and any and all accompanying documentation, files and materials. LICENSE GRANT: Subject to your agreement and compliance with the terms and conditions of this EULA, CoffeeCup grants to you a limited, personal, non-exclusive, non-transferable and revocable license (without the right to sublicense) to install, use, access, display and run one copy of the Software on the hard disk or other fixed storage medium of up to three (3) digital processors, computers, or workstations (collectively, "Devices") which you own or are under your control solely for your personal or internal business use. For the avoidance of doubt, the foregoing license may not be shared or used concurrently on multiple Devices without the purchase of additional licenses from CoffeeCup for each such Device accessing, displaying, running, and/or using the Software. INSTALLATION POLICY: With all purchases, you are authorized to install the software on up to 3 computers that you directly own and operate. We do this because we offer free, fully functional trial versions for all of our software this way you can download and try before you buy. One of the perks when you purchase anything from CoffeeCup is that we provide an immediate electronic download of the software program through the Customer Care Center. Because there is no way to guarantee that our software was actually removed from a system after it is installed, this allows us to help fight fraudulent activity. UPGRADE POLICY: In over 15 years of making amazing Web Design and other software products, CoffeeCup has in general, delivered improved versions of the software free of charge. We will continue to do so, especially when a new version mainly consists of minor improvements and fixes. However, from time to time there will be new versions that require rewrites of the application or parts of the application. This process requires significant research, design, development and testing time. In those situations and on a case by case basis, CoffeeCup reserves the right to require a fee for upgrading to the new and improved version of the software. Given the resources it would take, we would hate to withhold implementing these improvements purely based on financial decisions; charging a nominal fee for updates is the only way to accomplish this. If you don't feel new functionality is worth the upgrade you can always stay with your current version. Either way, the choice is entirely yours! We highly recommend subscribing to our newsletter to be informed about both minor and major updates to your applications. Also this is usually the best way to get a good deal' on both new software and new functionality releases. CROSS PLATFORM LICENSE POLICY: We offer many different programs for both Windows and OS X. Your license is only good for the operating system you purchased it for. So if you purchased the Windows version for example, but now you would like the OS X version, that will require a separate license. Unless you are a Responsive Program Member. In that case you will be able to use your software on up to 3 different computers, independent of the operating system they use. DISCONTINUED PURCHASE POLICY: As technology on the internet evolves there are times we may need to discontinue a program, theme, graphic etc. When that happens, these are removed from our website and will no longer be accessible through the Customer Care Center. We suggest you always keep local backups of all purchases so that you have them available to you. You may also purchase one of our USB drives loaded with all of your purchased software so you can ensure you have a backup copy if needed. FONT CONVERSION DISCLAIMER: Please be aware that certain font vendors do not allow the conversion of their font software programs into other formats.
