CryptArchiver (Lite/Basic/Personal/Standard/Enterprise) License (C) WinEncrypt, 2005. IMPORTANT : BEFORE PROCEEDING WITH THE INSTALLATION, EVALUATION AND/OR USE OF THIS SOFTWARE, CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT AND LIMITED WARRANTY. This is a legal agreement between you (either an individual or a single entity) and WinEncrypt for the software product identified above, which includes computer software and may include associated media, printed materials, "online" or electronic documentation, and Internet-based services ("Product"). An amendment to this license may accompany the said Product. You agree to be bound by the terms set forth in this agreement, by copying, installing, evaluating, distributing and/or otherwise using the product. If you do not agree, do not install or use this product. You may return it to your place of purchase for a refund. However, by copying, installing, using, evaluating, modifying, or distributing this Product, you indicate your acceptance of this license as a whole. This Agreement does not provide you with title or ownership of the Product, but only a right of limited use as outlined in this agreement. 1.GRANT OF LICENSE Installation and use. You may install, use, access, display and run one copy of the Product on a single computer, such as a workstation, terminal or other device. The Product may not be used by more than one user (The Licensee). In case you wish to use this product to transfer data between computers, all computers on which the data is accessed will require a separate license. Network Use. You may also store or install a copy of the Product on a storage device, such as a network server, used only to install or run the Product on your other computers over an internal network; however, you must acquire and dedicate an additional license for each separate computer on or from which the Product is installed, used, accessed, displayed or run. A license for the Product may not be shared or used concurrently on different computers. You may make a single copy of the Product for backup purposes. Reservation of Rights. WinEncrypt reserves all rights not expressly granted to you in this agreement. 2. UPGRADES. To use a Product identified by WinEncrypt as an upgrade, you must first be licensed for the original product identified by WinEncrypt as eligible for the upgrade. After you upgrade, you may no longer use the product that formed the basis for your upgrade eligibility. You will be governed by the terms and conditions of both agreements. 3. TRANSFER. Internal transfer. You may move the Product to a different computer. After the transfer, you must completely remove the Product from the former computer. Transfer to Third Party. You may make a one-time transfer of the Product to another end user. The transfer has to include all component parts, media, this agreement, the sale receipt, and if applicable, all printed materials. The transfer may not be an indirect transfer or a consignment. Prior to the transfer, the end user receiving the transferred Product must agree to all the terms in this agreement. No Rental. You may not rent, lease, lend or provide commercial services to third parties with the Product. 4. LIMITATION ON REVERSE ENGINEERING, DECOMPILATION, AND/OR DISASSEMBLY. You may not reverse engineer, decompile, and/or disassemble the Product, except and only to the extent that it is expressly permitted by applicable law notwithstanding this limitation. 5. TERMINATION. Without prejudice to any other rights, WinEncrypt may cancel your license if you do not abide by the terms and conditions of this agreement, in which case you must destroy all copies of the Product and all of its component parts. This License and your right to use the Product automatically terminate without notice from WinEncrypt if you fail to comply with any provision of this agreement, or any terms associated with the sale and/or evaluation of this Product. 6. ACADEMIC EDITION SOFTWARE. To use a Product identified by WinEncrypt as an "Academic Edition" or a "Student Edition", you must be a "Qualified Educational User". For qualification-related questions, please contact the WinEncrypt Customer Support Dept. 7. EXPORT RESTRICTIONS. US Specific information. You acknowledge that the Product is NOT of U.S. origin and NOT subject to U.S. export jurisdiction. This Product is NOT covered by US Department of State 22 CFR 120-130. Global information. This product uses strong cryptographic algorithms and techniques. Should such cryptography be regulated, controlled or illegal in your country, WinEncrypt or the authors will not be responsible for any consequences that may arise from your importing and/or using it in such a country. You agree to comply with all applicable international and national laws that apply to the Product. YOU MAY NOT IMPORT THIS PRODUCT INTO FRANCE. 8. LIMITED WARRANTY. Warranty against defects. WinEncrypt warrants that the Product will perform substantially in accordance with the accompanying materials for a period of thirty (30) days from the date of purchase. As to any defects discovered after the thirty day period, there is no warranty or condition of any kind. This limited warranty is void if failure of the Product has resulted from accident, abuse, misapplication, abnormal use or a virus. Implied Warranties. If an implied warranty or condition is created by your state/jurisdiction and federal or state/provincial law prohibits disclaimer of it, or if your state/jurisdiction does not allow limitations on how long an implied warranty or condition lasts, you may not use the Product. You may return it to your place of purchase for a refund. No warranty on updates. Any supplements or updates to the Product, without limitation, are not covered by any warranty or condition, express, implied or statutory. Other warranty. WinEncrypt, its Dealers, Suppliers, Associates and Resellers provide the Product and support services (if any) AS IS AND WITH ALL FAULTS, and hereby disclaim all other warranties and conditions, either express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, of reliability or availability, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of viruses, and of lack of negligence, all with regard to the Product and associated material, and the provision of or failure to provide support or other services, information, software, and related content through the Product or otherwise arising out of the use of the Product. There is no warranty or condition of Title, correspondence to description or non-infringement with regard to the product. 9. LIMITATION ON REMEDIES In no event will WinEncrypt be liable for direct, indirect, special, incidental, or consequential damages arising out of the use or inability to use the product or accompanying materials, even if advised of the possibility of such damages. This includes damages arising out of events covered in section 11 of this agreement. Your exclusive remedy for any damages is as follows. Except for any refund elected by WinEncrypt, YOU ARE NOT ENTITLED TO ANY DAMAGES, INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL DAMAGES. In no case shall WinEncrypt's liability exceed the amount of the license fee paid, or U.S. $1.00, whichever is greater. The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied, and will apply to the maximum extent permissible by law even if any warranty or remedy fails its essential purpose. Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. You may not use the Product under such laws. You may return it to your place of purchase for a refund. 10. ENTIRE AGREEMENT. This agreement (including any addendum or amendment to this agreement which is included with the Product) are the entire agreement between you and WinEncrypt relating to the Product and the support services (if any) and they supersede all prior oral or written communications, proposals and representations with respect to the Product or any other subject matter covered by this agreement. 11. REMEMBER YOUR PASSWORD. You understand and acknowledge that this product does not contain any "Backdoor" or any other remedy that would allow complete or even partial recovery of your data without knowing the correct password. Neither WinEncrypt, the Authors of the Product, nor any third party can help you to recover your data if you forget your password. In such an event, the data will be lost forever. WinEncrypt will not be responsible if you forget your password. See Sections 8 and 9 of this agreement for warranty and liability information. 12. COPYRIGHT AND LICENSING. The Product is protected by copyright and other intellectual property laws and treaties. WinEncrypt and its suppliers own the title, copyright, and other intellectual property rights in the Product. The Product is licensed, not sold.
