This agreement is between you, the user, and the Author, Colin Hill: DEFINITIONS Application means the installation program, as downloadable from the Internet, and all or any constituent files created during an installation. You or the user means the person who installed the application and agreed to these terms and conditions. LIMIT OF LIABILITY "Hillyheights Lockout", the application, is not guaranteed to be totally free of bugs but is guaranteed to perform essentially as detailed in the manual that installs with the application. In the event of the application not operating as specified, the Author undertakes to either provide a new version without the defect in a reasonable time or to refund any money paid at the Authors discretion. The Authors liability shall be strictly limited to the amount paid by the purchaser. If the application is being evaluated free-of-charge the Authors liability is zero. DISTRIBUTION and USE The application must not be sold or bartered or distributed in any way whereby the receiving party has to pay to receive the application. The application may be distributed entirely free of any change provided that the site http://lockout.hillyheights.co.uk is acknowledged as the source. Any copy so distributed must not be distributed with a licence key whether provided by the Author or devised by a third party. Any individual or organisation in receipt of the application may only use it for evaluation purposes as set out below. EVALUATION Once installed, the application will operate for a 31 day evaluation period and during that time it will provide all the functionality of the licensed version. The application must not be used after this 31 day period without the user purchasing a valid licence whether or not the application continues to operate with or without deliberate action by the user to make it operate beyond the evaluation period. The presence of a disabled, post-evaluation version of the application on a computer does not constitute use. LICENSING If the user wishes to use the application after the 31 day trial period they must purchase a licence key at the prevailing rate. The procedure for obtaining this key and for entering the key are given on http://lockout.hillyheights.co.uk. Each key licenses the application for use one individual computer on one instance of the operating system by all users of that computer. If the operating system of the computer is reinstalled, or reconfigured in an major manner, the application may stop operating and it may not be possible to reinstall it. In this instance the user must contact the Author for a new key and provide all the details requested. The Author may provide a new key free of change at his discretion. The user accepts that the Author may decline to reactivate the application if he believes that use of this service has been excessive or if he suspects that the licence conditions may have been, or could in future be, broken. The user accepts that the Authors decision is final and that the Author is not ever obliged to reactive the application. PERMISSION TO INSTALL You agree that you either own the computer on which you are installing the application or that you have the permission of the owner to install the application. You agree that you will be solely liable to the owner if you install the application without their permission. LOSS OF DATA You acknowledge that this application is designed to deny access to a computer by unauthorised persons and that it therefore carries a risk of making the computer inoperable without a total re-installation of its operating system. In particular this is likely to occur if the password is lost and forgotten. You agree that you do not rely on the computer to hold important data. You agree not to hold the Author responsible for loss of data or for any other consequential loss. You accept the possibility of having to re-install the operating system. You accept that Authors liability is limited to any money paid to him by you. You accept that the Author is only able to provide very limited support for such problems, as doing otherwise risks providing help to those trying to disable the application without the password-holders permission. You also accept that the application is designed to force the computer to shut-down and that this may cause programs to loose unsaved entries and data. PURPOSE OF APPLICATION The application is designed to prevent use by unauthorised persons at certain times of the day; a likely use is rationing a childs use of a computer. You accept that the application is not a security product and that a knowledgeable user may be able to defeat the application and continue using the computer. REDISTRIBUTION You agree to impose these conditions on any persons to whom you pass "Hillyheights Lockout". Including that they in turn agree to impose these conditions on all subsequent recipients. INTELLECTUAL PROPERTY The application is owned by Colin Hill and protected by UK and International Copyright laws. NO DISASSEMBLY OR ALTERATION The application must not be disassembled, decompiled or altered in any way without the express permission of the Author. JURISDICTION The application is distributed from England and licence keys are sold from England. You accept the sole jurisdiction of the English Courts in any dispute relating to the application. If any part of this contract is deemed unenforceable the remaining parts for the contract remain in force.
