If you do not agree to all statements in the Agreement, please do NOT use the Software. The License Agreement ("The Agreement") is made effective upon obtaining any software products made available by Prashant Varanasi & Michael Rose ("The Publisher"), hereafter denoted "The Software", by the user of the said software ("The User"). By downloading, copying or otherwise using the Software, you agree to be bond by the Agreement. License The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed and NOT sold. This Agreement grants you the right to install and use the Software on your computers. You may use the Software for the trial period in order to test the functionality to ensure it is working properly. Continued use of this product after the trial period requires that you register the program through the iPodSoft.com website. No Warranty The Publisher shall not be liable for any direct, indirect, special, incidental or consequential damages and losses, whether based on contract, tort or any other legal theory, arising out of any use or misuse of the Software or any sequential damages including but not limited to the distribution of the files created by the Software. The User agrees to indemnify, hold harmless, and defend the Publisher from and against any claims or lawsuits, including Attorney's fees, that arise or result from any loss, damage, or liability in any form. Performance The Publisher does not guarantee there are no imperfections or errors in the Software. The Software will not intentionally cause any malicious behavior. The Software creates and maintains certain Registry entries for the sole purpose of product usage and registration information management. Privacy Protection Any personal information disclosed to the Published as a result of registration will be held confidential and will not be disclosed to any third party for commercial or non-profit purposes. Copyright All rights, title, and copyrights in and to the Software and any copies of the Software are owned by Prashant Varanasi & Michael Rose. You may not reverse-engineer, decompile, or disassemble the Software. It is your own responsibility to ensure that you obtain all consents, authorizations and clearances in any data owned or controlled by third parties that you transmit, access or communicate to or from others using the program. `Plugins` or `Sites` used in conjunction with the program are not the property of the developers of the program. Any actions undertaken through the plugins are the actions of the user themselves and not the developers of the program, plugins will only be downloaded with consent from the user, and will never be downloaded automatically. Users are entirely responsible for their conduct and for ensuring that it complies with all applicable copyright and data-protection laws. In the event a user fails to comply with laws regarding copyrights, other intellectual property rights, data-protection and privacy, such a user may be exposed to civil and criminal liability, including possible fines and jail time. Termination Without prejudice to any other rights, the Publisher may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software and all of its component parts. Distribution Distribution is limited to the original setup of the software as downloaded from iPodSoft.com. You must supply the original downloaded setup file. You are specifically prohibited from charging for any copies of our software, however made, and from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission. Limitations of Liability THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. Good data processing procedure dictates that any program is thoroughly tested before relying on it. The user must assume the entire risk of using the program. Revision The Publisher reserves the right to make modifications to this Agreement at any time. This Agreement may contain typographical errors.
