By downloading or using JPad Pro(tm), you indicate your agreement to the terms of this license agreement. JPad Pro is owned by Modelworks Software and its suppliers and is protected by United States copyright laws and international treaty provisions. Except to the extent expressly licensed herein, all rights are reserved to Modelworks Software and its suppliers. You may not rent, lease, sell, sublicense, assign, or otherwise JPad Pro or any of its components. You may not reverse engineer, decompile, or disassemble JPad Pro or any of its components. Modelworks Software and its suppliers shall retain title and all ownership rights to JPad Pro and its components. DISTRIBUTION. You may copy and distribute the demonstration version of SitePad Pro provided that this license agreement and all other files included with the copy. You are prohibited from charging, or collecting a fee, for any such copies. You are also prohibited from distributing SitePad Pro evaluation with any other products without prior written permission. RESTRICTED RIGHTS: Use, duplication or disclosure by the US government is subject to the restrictions as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer Software Clause as DFARS 252.227-7013 and FAR 52.227-19. NO WARRANTIES. To the maximum extent permitted by applicable law, Modelworks Software and its suppliers expressly disclaims any warranty for JPad Pro and its components. JPad Pro and related files are provided AS IS without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. The entire risk arising out using JPad Pro remains with you. LIABILITY. Modelworks Software's entire liability and your exclusive, at Modelworks Software's option, shall be the cost of JPad Pro or its replacement with another copy of JPad Pro. To the maximum extent permitted by applicable law, in no event shall Modelworks Software or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this Modelworks Software product, even if Modelworks Software has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. GOVERNING LAW.
