LOGOTRON 2.01 The computer trainer for foreign words retention ---------------------------------------------------------------------------- 1. END USER LICENSE AGREEMENT Alan Ardzinov ("AUTHOR") agrees to provide the user ("USER") with a copy of this software product ("SOFTWARE"), and grants the USER a limited license to use the SOFTWARE. ("LICENSE") This LICENSE defines what the USER may do with the SOFTWARE, and contains limitations on warranties, liabilities and remedies. This LICENSE may be revoked by AUTHOR at any time without notice if the USER fails to comply with the terms of this LICENSE. 2. The copyright and all other rights in the SOFTWARE shall remain with AUTHOR only. 3. LICENSE OF UNREGISTERED SOFTWARE An unregistered copy of the SOFTWARE ("UNREGISTERED SOFTWARE") may be used by the USER for evaluation purposes for a period of thirty (30) days following the initial installation of the UNREGISTERED SOFTWARE. ("TRIAL PERIOD") At the end of the TRIAL PERIOD, the USER must either register the SOFTWARE or remove it from his system. The UNREGISTERED SOFTWARE may be freely copied and distributed to other users for their evaluation. 4. For the registration of the SOFTWARE USER have to: 4.1. Arrange the payment for the SOFTWARE. The price and available forms of payment are defined on the AUTHOR'S web-site: http://www.terchy.com 4.2. Fill and submit the on-line registration form on AUTHOR'S web-site. 4.3. After payment and on-line registration USERS will get the registration password from AUTHOR, by e-mail. 4.4. Registration password must be entered into the program, after that the registration will be considered completed and USER can continue to use the REGISTERED SOFTWARE. 5. LICENSE OF REGISTERED SOFTWARE After the registration USER gets the following rights: 5.1. To use the REGISTERED SOFTWARE with personal, non-commercial purposes 5.2. To copy the REGISTERED SOFTWARE to other computers with personal, non-commercial purposes. In this case it will be necessary to enter the registration login and password, otherwise the SOFTWARE will work in trial mode. 5.3. To obtain the direct next version by half-price (50% discount). 5.4. Rights to the REGISTERED VERSION are not transfer automatically to the next version. 6. LIMITATION OF RIGHTS Nobody except the AUTHOR has the rights to: 6.1. sell, rent, lease, sublicense the REGISTERED SOFTWARE or use it in any way except personal non-commercial purposes. This LICENSE may not be assigned or otherwise transferred without the prior written consent of AUTHOR. 6.2. modify, disassemble, decrypt, reverse, engineer or de-compile the SOFTWARE and any auxiliary part of the SOFTWARE. All rights which are not explicitly given here shall remain with AUTHOR. 7. AUTHOR grants the following guarantees to the USER registered the SOFTWARE: 7.1. To render an efficient support and give quick e-mail answers for questions concerned with using the SOFTWARE. 7.2. Not to give any information about USER gained during the registration and correspondence to any other third parties. 7.3. The SOFTWARE will not gain and transfer any information in process of using. 8. DISCLAIMER OF WARRANTY AND LIABILITY This SOFTWARE is provided "as is" without representations or warranties of any kind, whether expressed or implied. The USER must assume the entire risk of using the SOFTWARE, and AUTHOR shall have no liability to the USER or any other third-party for any damages whatsoever, including, but not limited to, any economic, moral, psychological or data loss. 9. ACCEPTANCE OF THIS LICENSE AGREEMENT By downloading and/or installing this SOFTWARE, the USER agrees to the terms of this LICENSE. This LICENSE shall continue for as long as the USER uses the REGISTERED SOFTWARE and/or distributes the UNREGISTERED SOFTWARE accordiong to the terms of this agreement. However, this LICENSE will terminate if the USER fails to comply with any of its terms or conditions. The USER agrees, upon termination, to destroy all copies of the REGISTERED and/or UNREGISTERED SOFTWARE. The limitations of warranties and liability set forth in this LICENSE shall continue in force even after termination. AUTHOR can change the content of this LICENSE for the current or any following versions of the SOFTWARE. At the same time, for the current version of the SOFTWARE, the relations between the AUTHOR and the USER are continue to be under the edition of this LICENSE wich was actual at the moment when the USER registered the SOFTWARE.
