This SOFTWARE is licensed, not sold. All rights reserved for MizuTech SRL BY RUNNING THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT EXECUTE IT! You must destroy all copies of the Software upon termination. Mizu Server SOFTWARE FREE EDITION. ------------------------------------------- MizuTech grants you a non-exclusive license to use the software free of charge for evaluation, trial, educational or home usage purposes. FULL or CUSTOMIZED VERSIONS ------------------------------------------- 1 (one) Server License (plus 1 backup server). 1 server means 1 public interface (domain) with max. 8 installed CPU. Licenses must be obtained only from Mizutech (www.mizu-voip.com) TERMS APPLICABLE TO ALL LICENSE GRANTS ------------------------------------------- This license does not entitle you to hard-copy documentation, support or telephone assistance. You must also accept the GNU General Public License (http://www.gnu.org/licenses/gpl-3.0.txt), because Mizu Server uses some GPL licensed binaries. Mizutech is NOT responsible for the content of the install package, for the functionality of the software and for the usage of the software. SCOPE OF LICENSE GRANT ------------------------------------------- You may: Use the Software on any single computer; Use a hot backup copy on a second computer. Use the Software on a second computer so long as only one (1) copy is used at a time; You may not: Copy the Software other than as specified above; Permit other individuals to use the Software except under the terms listed above; Permit concurrent use of the Software; Reverse engineer, decompile, or disassemble the SOFTWARE Modify the software in any way. Publish, resell or copy it for others! ( w/o prior permission); Rent, lease, grant a security interest in, or otherwise transfer purchase rights of the Software ( w/o prior permission); Remove any proprietary notices or labels on the Software. TITLE ------------------------------------------- Title, ownership rights, and intellectual property rights in the Software shall remain with MizuTech and/or its suppliers. The Software is protected by copyright and other intellectual property laws and by international treaties. Title and related rights in the content accessed through the Software is the property of the applicable content owner and is protected by applicable law. The license granted under this Agreement gives you no rights to such content. TERMINATION ------------------------------------------- This Agreement and the license granted hereunder will terminate automatically if you fail to comply with the limitations described herein. Upon termination, you must destroy all copies of the Software. MISCELLANEOUS ------------------------------------------- Mizu Server use strong cryptography components that are restricted in some parts of the word. Don't install Mizu Server if the restriction applies to you! Contact a lawyer if you are not sure. MizuTech is not liable for any violations you make here. It is your responsibility. Mizu Server occasionally can send data to MizuTech servers containing your windows version, disk id, ip address and license key. MizuTech will disable copies with invalid license keys. This Agreement represents the complete agreement concerning the license granted hereunder and may be amended only by a writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER. If any provision of this Agreement is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable. SCOPE OF LICENSE GRANT ------------------------------------------- THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIZUTECH SRL DISCLAIMS ALL LIMITED WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SOFTWARE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PUCUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF SECOND NATURE SOFTWARE, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. HIGH RISK ACTIVITIES ------------------------------------------- The Software is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Accordingly, Licensor and its suppliers specifically disclaim any express or implied warranty of fitness for High Risk Activities. Windows is a trademark of Microsoft Corporation, registered in the United States and other countries. OpenH323 are licensed under MPL. VideoLAN is a software project, which produces free software for video, released under the GNU General Public License (GPL version 2). UltraVNC is licensed under the the GNU General Public License. Some video and audio codecs that can be used with Mizu Server (plug and play) can be patented in your country and require you to pay royalties to their licensors (patent license per channel) unless it is used in pass-thru mode. In these cases, you become responsible for complying with the licensing and royalty requirements. For modules licensed under the the GNU General Public License, the source code is included on the install CD and you can find the exact link to the projects webpages in the documentation.
