This license agreement is a legal agreement between you and Study Hall Software. By installing, copying, activating or otherwise using this software you agree to be bound by the terms of this agreement. You may use the software only as described in this End User License Agreement (EULA). This software is licensed, not sold. 1. Copyrights and Trademarks You acknowledge that you have only the limited, non-exclusive right to use and copy the software as expressly stated in this license agreement and that Study Hall Software retains title to the software and all other rights not expressly granted. This software is protected by United States Copyright Laws and International Copyright Treaties. Where trademark names may appear within this software they are used for editorial purposes only and to the benefit of the trademark owner, with no intention of infringing upon that trademark. 2. Grant of License Evaluation Copy If you acquired this software on an evaluation or trial basis then Study Hall Software grants you a non-exclusive, limited license to evaluate the software without charge. Evaluation use is limited to those practice tests which are identified on the program test selection screen as "demo tests". To use the non-demo practice tests you must purchase a licensed version of the software. Licensed versions use an Activation Key which may be purchased using the Study Hall Software online ordering system. Licensed Copy If the software is installed and activated on a network server or other network storage device, an Activation Key must be purchased for each separate user having access to the software. If the software is used in a classroom training environment an Activation Key must be purchased for each student. Except as noted below an Activation Key may not be shared by alternating its use on different computers. A licensed user may install and activate one copy each of the software on his or her home computer, work computer and portable computer. You may also copy and redistribute the software freely provided no fee is charged and it does not include an Activation Key. You may not share or redistribute the Activation Key which has been provided to you. 3. Restrictions You may not reduce the programming code contained in this software to human readable form, reverse engineer, decompile, disassemble, or modify the software in any way. You may not remove or modify any copyright or trademark notices or license agreement included in this software. You may not rent, lease, lend, sublicense, or otherwise use the software in a manner which is inconsistent with this license agreement. 4. Warranty Exclusion To the extent permitted by applicable law, the software is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, title, fitness for a particular purpose, non- infringement, compatibility, security or accuracy. Your use of this software is at your own risk and you assume full responsibility and risk of loss resulting from your downloading, installing, and/or use of the software. 5. Limitation of Liability Study Hall Software is not liable to you for any consequential, special, incidental, or indirect damages of any kind arising out of the delivery, performance, or use of this software, even if we have been advised of the possibility of such damages. Our liability, for any claim related to your purchase or use of the software, whether in contract, tort, or any other theory of liability will not exceed the greater of U.S. $1.00 or the license fee paid by you. 6. Termination This license terminates if you fail to comply with its terms and conditions. If your license terminates, you must destroy all licensed copies of the software. The termination of this license does not limit Study Hall Softwares other rights it may have by law.
