LICENSE AGREEMENT GRANT OF LICENSE This License Agreement (License) permits you to use one copy of this version of the Britsoft Ltd. software product, which may include online or electronic documentation (the SOFTWARE) on a single computer. If this package comes with a license agreement for more than one copy, you may make and use additional copies of the SOFTWARE up to the number of Licensed Copies as authorised in the license agreement. The Software is in use on a computer when it is loaded into temporary memory (e.g.: RAM) or installed into permanent memory (e.g., hard disk, CD-ROM, or other storage device) of that computer except that a copy installed on a network server for the sole purpose of distribution to other computers is not in use. Although you are encouraged to make a backup copy of the Software for your own use, you are not allowed to make unlimited copies. The Software is protected by the copyright laws that pertain to computer software. It is illegal to make copies of the Software except for backups. It is illegal to give copies to another person, or to duplicate the Software by any other means, including electronic transmission. The Software contains trade secrets and in order to protect them you may not decompile, reverse engineer, disassemble or otherwise reduce the software to human perceivable form. You may not modify, adapt, translate, rent, lease or create derivative works based upon the Software or any part thereof. TRADEMARKS All brands or products are trademarks or registered trademarks of their respective holders and should be treated as such. WARRANTY Britsoft Ltd. warrants that the original CD/disks is/are free from defects in material and workmanship, assuming normal use, for a period of ninety (90) days from date of purchase. If a defect occurs during this period, you may return your CD-ROM to Britsoft Ltd., along with a dated proof of purchase; Britsoft Ltd. will at its discretion replace it free of charge. After 90 days, you may obtain a replacement by sending Britsoft Ltd. your defective CD and a cheque for 20 British Pound Sterling. This warranty ends at the moment that Britsoft Ltd. discontinues with the version of the product. EXCEPT FOR THE EXPRESS WARRANTY OF THE ORIGINAL DISKS SET FORTH ABOVE, BRITSOFT Ltd. GRANTS NO OTHER WARRANTIES, EXPRESS OR IMPLIED, BY STATUE OR OTHERWHISE, REGARDING THE DISKS AND RELATED MATERIALS, THEIR FITNESS FOR ANY PURPOSE, THEIR QUALITY, THEIR MERCHANTABILITY OR OTHERWHISE. BRITSOFT LTD IS NOT OBLIGATED TO PROVIDE ANY UPDATES TO THE SOFTWARE THE LIABILITY OF BRITSOFT Ltd. UNDER THE WARRANTY SET FORTH ABOVE SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT. IN NO EVENT SHALL BRITSOFT LTD. BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES FOR BREACH OF WARRANTY. VIRUSES IT IS YOUR RESPONSIBILITY TO CHECK FOR VIRUSES BEFORE USING ANY SOFTWARE AND BRITSOFT Ltd. DISCLAIMS ANY OTHER OR FURTHER LIABILITIES TO YOU FOR ANY VIRUS-CAUSED DAMAGE. PRODUCT IMPROVEMENTS BRITSOFT Ltd. reserves the right to make corrections or improvements to the Program and its documentation and to the related diskettes and/or CD at any time without notice and with no responsibility to provide these changes to purchasers of earlier versions of such products. HIGH RISK ACTIVITIES The software is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the software could lead directly to death, personal injury, or severe physical or environmental damage.
