LICENSE AGREEMENT Please read this License Agreement carefully before purchasing, installing and using this product. By purchasing, downloading, installing and using this product, you are agreeing to be bound by the terms of this License. If you do not agree to the terms of this License, this process will be cancelled. 1.) License. The Product accompanying this license is licensed to a single user ("you") by PowerFlashCards ("us"). PowerFlashCards retains title to the Product. You may not transfer your license rights in the Product to any other party. This license allows you to use the Product on one computer. 2.) Restrictions. You may NOT distribute copies of the Product to others or electronically transfer the Product from one computer to another over a network or otherwise. The Product contains copyrighted material, trade secrets, and other proprietary information. In order to protect them you may not reverse engineer, disassemble, decompile, or reduce the Product or its direct products to any human readable form. You may not modify, adapt, translate, rent, lease, loan, resell, distribute or network the Product in whole or in part. 3.) Disclaimer of Warranty on Product. You expressly acknowledge and agree that use of the Product is at your sole risk. Under no circumstances, including negligence, shall PowerFlashCards be liable for any incidental, special, or consequential damages that result from the use or inability to use the Product, even if we have been advised of the possibility of such damages. Some states and some countries do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall PowerFlashCards's total liability to you for all damages, losses, and causes of action, whether in contract, tort (including negligence) or otherwise exceed the amount paid by you for the Product. 4.) Refund Policy. PowerFlashCards is offering software products, which are downloaded, and installed after purchase on individual computers. Because these goods are of intangible nature, and cannot be returned in any form, PowerFlashCards does not issue refunds after the product has been purchase and/or downloaded and/or installed. You (our customer), are responsible for understanding this upon reviewing our License Agreement before purchase and making sure your shopping cart only contains the product(s) you intend to purchase. 5.) Controlling Law and Severability. This License shall be governed by and in accordance with the laws of the United States and the State of Massachusetts. If any part of this Agreement is deemed invalid or unenforceable, the remainder shall continue in full force and effect. 6.) Entire Agreement . This license is the entire Agreement between you and PowerFlashCards concerning the use of the Product. No amendment or modification to this Agreement will be binding unless signed in writing by a representative of PowerFlashCards. 7.) Copyright and Trademarks. The Product and all accompanying files and documentation is copyrighted by PowerFlashCards. PFC logo and all PowerFlashCards product names are trademarks of PowerFlashCards.
