PolyMap® Software License Agreement (Revised: 02-Mar-2009) Ambiente Informática Ltda is owner of PolyMap® Software(hereinafter "Software"), a desktop mapping solution. By installing the Software, you agree to observe the terms and conditions of this License Agreement. If you do not agree to the terms and conditions of this Agreement do not install this Software. The Software is licensed (not sold) under yearly subscriptions allowing Licensee to use the Software during the specified subscription period. Grant of Software License - By subscribing to the Software, Ambiente Informática Ltda, the licensor, grants to the licensee a nonexclusive right, without right to sub-license, to use the Software for the term of the subscription including any program updates or maintenance releases of the Software during the subscription term. You may not lease or rent this Software. Ambiente Informática Ltda reserves all rights not expressly granted, and retains title and ownership of the Software, including all subsequent copies in any media. You may not modify; adapt; translate; reverse engineer; decompile; disassemble; or create derivative works based on the software. You may not modify, adapt, translate, or create derivative works based on the written materials without the prior written consent of Ambiente Informática Ltda. Ambiente Informática Ltda assumes no responsibility whatsoever for any errors that may appear in the written materials. Term - The term of this Agreement shall run an initial 12-month period (first year subscription) and for each annual period for which the subscription is renewed. Ambiente Informática Ltda offers multiple year subscriptions. LIMITED WARRANTY: If distributed via magnetic media, Ambiente Informática Ltda warrants that the media on which the Software is distributed will be free from defects for a period of sixty (60) days from the date of delivery of the Software to you. Your sole remedy in the event of a breach of this warranty will be that Ambiente Informáica Ltda will, at its option, replace any defective media returned to Ambiente Informática Ltda within the warranty period or refund the money you paid for the Software. Ambiente Informática Ltda does not warrant that the Software will meet your requirements or that operation of the Software will be uninterrupted or that the Software will be error-free. If software was received via download, user may request to download a replacement of the software via the same method. Upon termination, you will immediately destroy the Software or return all copies of the Software and documentation to Ambiente Informática Ltda. SEVERABILITY: The terms and conditions stated in this Agreement are declared to be severable. If any paragraph, provision, or clause in this Agreement shall be found or be held to be invalid or unenforceable in any jurisdiction in which this Agreement is being performed, the remainder of this Agreement shall be valid and enforceable and the parties shall use good faith to negotiate a substitute, valid, and enforceable provision which most nearly effects the parties' intent in entering into this Agreement. This Agreement will be governed by the laws of the state of Santa Catarina, Brazil.
