BIRNAM LABS ELECTRONIC END USER LICENSE AGREEMENT FOR POPSMARTS BETA TEST. NOTICE TO USER: THIS IS A CONTRACT. BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS END-USER-LICENSING-AGREEMENT (EULA). By accepting this agreement and continuing with the installation process of this beta version of popSmarts Popup Killer (The Product), you (The Tester) are entering into contract with Birnam Labs, LLC (The Company) to legally perform and behave within the following Non-Disclosure Agreement Terms (NDA) for the duration of the testing period as determined by The Company. This period is set arbitrarily by The Company and is announced to The Tester during receipt of The Product installation software. Accepting this agreement testifies the The Tester is aware of the duration of this testing period. 1. Use of The Product is limited to The Tester and shall not be re-distributed in any manner. The only entity capable of distributing The Product in beta form is The Company, and there will be exactly ONE copy distributed per Tester. Any copies distributed by an entity other than The Company are considered invalid and use of The Product in this form will be considered in violation of The NDA. The Product distributed to The Tester is only licensed for one computer. Installation on more than one computer will be considered violation of The NDA. 2. The Company is not to be held responsible for any damage, permanent or otherwise, that results from installation, use, misuse, or uninstallation of The Product. The Product is distributed AS IS and can not be blamed for unwanted results. 3. The Company is not to be held responsible for The Product acting in a manner other than as advertised. Any undesired behavior from The Product must be a) accepted AS IS, and b) reported in the summary submitted by The Tester at the end of the testing period (Section 5). 4. The Tester agrees that any and all errors, complaints, and other problems discovered during the testing period will be thouroughly, accurately and honestly reported to The Company immediately after occurring, and will included in a summary of events following the testing period (Section 5). 5. The Tester agrees to complete a summary of events following the testing period. This summary shall include a description of every problem, whether it is critical or simply undesirable, encountered by The Tester during the testing period. This summary shall also include the full test of any error message, whether generated by the system or by The Product, and other relevant information that may effect interpretation of this error message. This summary shall also include full detailed information about the computer used during testing. 6. The Company agrees to reward the Tester at the end of the testing period with one (1) copy, with registration codes, of the full non-beta version of The Product. Reward is of indeterminant value. The Tester shall only be applicable for this reward under the condition that The Tester has followed the terms and conditions of this EULA, including Section 5, which outlines the submittal of a summary report. The Tester is to receive only one copy of the non-beta version of The Product. The Tester is granted all of the benefits of purchase, including free upgrades for one year and free email support.
