LICENSE AGREEMENT You should carefully read the following terms and conditions before using this software. Your use of this software indicates your acceptance of this License Agreement and warranty. One-2-Five Theory E-Tutor is Copyright (C) 2006 Classycool Music (Mike Spillane). DEFINITIONS The following definitions shall apply in this document: "Classycool Music": Mike Spillane (Author), Middle Farm, Stainton, Barnard Castle, Co. Durham, DL12 8RH. "One-2-Five Theory E-Tutor": Each E-Book is a self-contained Windows program (.EXE). "USER": You - any person using One-2-Five Theory E-Tutor. "REGISTERED USER": A USER who has paid the registration fee to Classycool Music (Mike Spillane) for use on a particular computer. In the event that a REGISTERED USER is refunded or the registration fee is charged back, said USER shall revert to being an UNREGISTERED USER. "UNREGISTERED USER": A USER who has not paid the registration fee to Classycool Music. "READER": a person using E-Books created by USERs. REGISTRATION BY PURCHASING A PASSWORD "DIRECT" USE ONLY 1.The license is granted to a single USER only. 2. USERs (such as private music teachers) who wish to distribute copies to individual pupils for use on other remote computers may obtain a multiple license from the authors of this E-book and charge their pupils a fee if they so wish. NO LIABILITY, NO WARRANTIES 1. In no event will Classycool Music be liable to any party for any direct, indirect, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of the One-2-Five Theory E-Tutor, even if Classycool Music is expressly advised of the possibility of such damages. 2. One-2-Five Theory E-Tutor and the accompanying files are provided "as is" and without warranties as to performance of, merchantability or any other warranties whether expressed or implied. The USER assumes the entire risk of using One-2-Five Theory E-Tutor. 3. Even if these limitations are found not to apply, the maximum liability of Classycool Music will be limited to replacement of the E-book or refund of the registration fee paid to the REGISTERED USER. 1. No formal product support is provided, but USERs are encouraged to send questions, comments or suggestions to Classycool Music by e-mail or by writing. GOVERNING LAW 1. This agreement shall be interpreted in accordance with the laws of England. The USER consents to the exclusive jurisdiction of the English courts. The USER agrees that any legal action against Classycool Music, relating to this agreement will be brought in the courts of London, England.
