INTRODUCTION YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THIS SOFTWARE PACKAGE. IF YOU DO NOT AGREE WITH THEM, PLEASE DISCONTINUE USE OF THE PRODUCT. PC Dynamics provides this program and licenses its use under the terms and conditions stated herein. You assume responsibility for the selection of the program to achieve your intended results, and for the installation, use and results obtained from the program. LICENSE AGREEMENT This agreement gives you the right to: a. use the program on a single primary machine; a. additionally, use the program on a single secondary machine which is primarily operated by you, such as a personal laptop computer which you routinely use in addition to your primary computer; c. copy the program into any machine readable form for backup purposes in keeping with your use of the program on the single machine; d. transfer the program and license to another party if the other party agrees to accept the terms and conditions of this Agreement. If you transfer the program, you must at the same time either transfer all copies whether in printed or machine-readable form to the same party or destroy any copies not transferred; this includes all modifications and portions of the program contained or merged into other programs. YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE PROGRAM, OR ANY COPY, MODIFICATION OR MERGED PORTION, IN WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS LICENSE. IF YOU TRANSFER POSSESSION OF ANY COPY, MODIFICATION OR MERGED PORTION OF THE PROGRAM TO ANOTHER PARTY, YOUR LICENSE IS AUTOMATICALLY TERMINATED. SITE LICENSE If you or your organization has purchased a site license for this software, that license or purchase agreement may contain additional rights or restrictions which shall automatically be incorporated into this Agreement. In the event of a conflict between any terms and conditions in this Agreement and a written purchase agreement executed by PC Dynamics, then the terms in the purchase agreement shall be the ones deemed to be in force. All terms and conditions in this Agreement and any such purchase agreement which are not in conflict with each other shall remain in force. TRIAL-MODE LICENSE This software may optionally be installed and operated in free trial mode. If you choose to install this software in trial mode by choosing this option when running the setup program, you are hereby granted the right to use the software and all features offered by the trial-mode installation for up to 30 days in order to evaluate the software prior to making a final purchase decision. After 30 days, this software may futher restrict access to certain application features. You may remove such restrictions by purchasing a retail copy of the software and entering your product activation key where provided within the setup program or the installed software. You may freely include copies of the trial-mode installation program on USB memory sticks, CD/DVDs and other external media as may be necessary to have full and immediate access to your protected data files which might also be stored on that same media. You may install the trial-mode software on any number of machines without being required to purchase extra licenses. In this mode, the trial software will allow full read-write access to your protected files, from any computer, while still being in full compliance with this Agreement. Once you enter an activation key into the software, the software switches from trial mode to live mode and will normally require that a license be obtained for that machine; subject to the allowance for installing the software on a single secondary machine. PASSWORDS You assume full responsibility for your own selection of encryption passwords. PC Dynamics shall not be liable in the event your password is lost, stolen or compromised in any way. PC Dynamics is also unable to recover forgotten passwords. DATA BACKUPS You assume full responsibility for caring for your personal data. Files protected by SafeHouse should be backed up and cared for as would be any other important files. PC Dynamics shall not be liable in any way for any loss of data related or unlrelated to the use of this software. Files may be securely backed up in encrypted form. Please see the product's documentation for instructions. INTERNET DOWNLOAD SITES Operators of public Internet software download sites may freely post a copy of the trial software on websites for free public downloading. Activation keys may not be published to the Internet in any form, and doing so is in violation of this Agreement. PC Dynamics reserves the right to revoke this granted right from any website or website operator who, in our sole opinion, allows or promotes content which is illegal or in conflict with our company's policies. SOFTWARE UPDATES A software update is defined as a new published change to the software having a same major version number to the left of the decimal point as the version you purchased. You are entitled to free updates for 30 days from date of purchase, or as may otherwise be made available to you. TERM OF LICENSE The license is effective until terminated. You may terminate it at any time by destroying the program and all copies, modifications and merged portions of the program in any form. The license also terminates upon conditions set forth elsewhere in this Agreement or if you fail to comply with any term or condition of this Agreement. Upon termination, you agree to destroy the program together with all copies, modifications and merged portions in any form. LIMITED WARRANTY THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU (AND NOT PC Dynamics, OR AN AUTHORIZED PERSONAL COMPUTER DEALER) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICE, REPAIR OR CORRECTION. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. GENERAL You may not sublicense, assign or transfer the license or the program except as expressly provided in this Agreement. Any attempt otherwise to sublicense, assign, or transfer any of the rights or obligations hereunder is void. This Agreement will be governed by the laws of the State of California, USA. YOU FURTHER AGREE THAT THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
