End User License Agreement 1. End User Software License Agreement Mediostream Corporation Inc., (collectively "Mediostream") owns all copyrights and other proprietary rights in this product (collectively the "Software"). Subject to the terms of this Agreement, you have a non-exclusive, nontransferable right to install the Software onto the hard drive or other mass storage device of one (1) computer and use the Software on the computer solely for your personal non-commercial use. 2. Limitations In order to use this Software, you may not; 1) Copy, modify, distribute, rent, or transmit or provide access to the Software to or for the benefit of a third party or, 2) Reverse engineer, decompile or disassemble the Software. 3. Warranty and Limited Warranty 1) If the Software recordable media has physical defects (damage, scratch). 2) If the Software will not perform substantial in accordance with the accompanying written materials and cause any loss while using the Software which is evidently attributable to Mediostream. 3) In no event will Mediostream be liable for any damages arising out of the use of, or inability to use of the Software unless expressly granted herein. Mediostream’s total liability to you for actual damages for any cause whatsoever will be limited to the amount paid by you for the software that caused such damage. However, if the Software is accompanied with some kind of Hardware, the liability for such damage will be limited to the amount prescribed by Mediostream. 4. Miscellaneous 1) In the event that you fail to comply with this EULA, Mediostream may terminate the license and you must destroy all the components and copies of the Software. 2) This EULA shall be concluded, given effectiveness, construed and governed by in accordance with the laws of the Japan.
