SINGLE USER PRODUCT - This is a legal agreement between you, the end user, and sportcode.co.rs. - digital river publisher SportCoding (we, us, our) from Serbia.This agreement is governed by the laws of the Serbia. Activation of SportCoding Software indicates that you accept to be bound by the terms of this agreement. 1. LICENSE (for all our editions) - We grants you the non-exclusive license to activate and use one copy of the enclosed our software program (the "SOFTWARE") on a single personal computer for personal use not a server, per year or more on request. The SOFTWARE is in "use" on a computer when it is loaded into temporary memory (i.e. RAM) or installed into permanent memory (e.g., hard disk, CD ROM, or other storage device) of that computer; you need paid the additional service fee for unlock your license in a case of format and/or damaged temporary and/or permanent memory (e.g., hard disk), reinstall or change Windows OS, if you did not use remove license from our software. We reserve the right to change terms and conditions under which the software is offered in this agreement. 2. COPYRIGHT - The SOFTWARE is owned by us and is protected by Serbia copyright laws, international treaty provisions, and all other applicable national laws. 3. OTHER RESTRICTIONS - YOU MAY NOT MODIFY, ADAPT, TRANSLATE, RENT, LEASE, LOAN, RESELL FOR PROFIT, DISTRIBUTE, NETWORK OR CREATE DERIVATIVE WORKS of the SOFTWARE. You may not reverse engineer, decompile or disassemble the software. Absolutely no derivative works of any kind may be created from the software. LIMITED WARRANTY LIMITED WARRANTY - We warrants that the SOFTWARE will perform substantially in accordance with the accompanying Help documentation. We also warrants that, where applicable, the media on which the software is distributed are free from defects in materials and workmanship. If We are unable to replace defective media or documentation or correct substantial software errors, We will refund the license fee. These are your sole remedies for any breach of warranty. NO OTHER WARRANTIES - Because software is inherently complex and may not be completely free of errors, you are advised to verify your work. The above is the only warranty of any kind, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability and fitness for a particular purpose that is made by Us. NO LIABILITY FOR CONSEQUENTIAL DAMAGES - In no event shall Us or our Affiliates be liable for special, indirect, inconsequential or incidental damages whatsoever of the LICENSEE or any third party, even if we have been notified of the possibility of such damages, including, without limitation, death or personal injury, property loss, lost profits, lost revenue or failure to realize expected savings, or other pecuniary loss arising out of the use of or inability to use this our product. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages so the above limitation or exclusion may not apply to you. In any case we entire liability under any provision of the agreement shall be limited to the amount actually paid by you for the SOFTWARE.
