LICENCE FOR REGISTERED USERS SOFTWARE LICENCE AND LIMITED WARRANTY IMPORTANT! READ CAREFULLY. This End-User Licence Agreement (EULA) is a legal agreement between you (an individual or a legal entity) and Aplicaciones Empresariales con Redes Neuronales, S.L. (Business Applications With Neural Networks, Ltd.) from now on referred to as AERN. By using this SOFTWARE, you agree to be bound by the terms of this EULA, that may include associated software components, printed material, support software for physical storage and on-line or electronic documentation and software downloaded on-line or in any other electronic medium. When installing, copying, downloading, having access to, or using in any other way the SOFTWARE PRODUCT, you accept the terms of this EULA. If you do not agree to the terms of this EULA, you may not install or use the SOFTWARE PRODUCT; on the contrary, return it to where you obtained it from in order to get a refund of the total amount of its retail price. SOFTWARE LICENCE 1.- GRANT OF LICENCE: The property, object of this user licence, including the patent rights and the copyrights, lies with AERN (including magnetic support, handbooks, and any other material which accompanies this product). THE SOFTWARE PRODUCT is protected by property laws and international treaties with regard to royalties, as well as by other copyright laws and treaties. THE SOFTWARE PRODUCT is licensed, not sold. AERN, as licensee, grants you the non-exclusive right to use the software program (from now on referred to as "Software") in accordance with the terms laid down in this licence. The Software is used only on one single computer at any time. The purchaser undertakes to acquire additional copies, if he wishes to use them simultaneously on more than one computer. You can execute the Software from a common shared disc through many PCs, provided that a licence of the authorized copy of the Software for each PC that it executes has been acquired. 2.- GRANT OF LOCATION LICENCE In case you have acquired a LOCATION LICENCE, you have the right to use the Software simultaneously according to the number of PCs specified in the licence. Each individual PC user, workstation connected to a network, network PC, notebook, terminal or workstation connected to a PC of many users or other types of computers considered as a simple computer are considered as "simple PC" for the purpose of this licence. 3.- BACKUP. AERN reserves the copyright, the title and the property of the Software, as well as of the written material, regardless the form or the medium on which the original copy is available and all the other copies. You can make only one (1) copy of the Software in order to make exclusively a backup copy for archive purposes. I agree to what is expressly laid down in this EULA, I may not make in any other way copies of the SOFTWARE PRODUCT or of the printed material accompanying the Software. When making a backup copy you have to reproduce and include the copyright notice. 4.- ROYALTIES. All title and copyrights in and to the Software (including, but without limitations to, images, photographs, animations, video and audio material, music, text ...), the printed material accompanying it and all the copies of the Software are property of AERN. All title and intellectual property rights corresponding to the contents which you may access by using the Software are property of the respective owner of the contents and can be protected by applicable laws and treaties about royalties and copyrights. This EULA does not give you the right to use these contents. AERN reserves all rights which are not expressly given so. 5.- LIMITATIONS ON ENGINEERING, DECOMPILATION AND DISASSEMBLY. You may not use reverse engineering techniques, decompilate, or disassemble the Software, except and only that such activity is expressly permitted by applicable laws notwithstanding this limitation. 6.- SEPARATION OF COMPONENTS. The Software is granted with licence as unique product. Its components may not be separated for its use in more that one computer or PC. 7.- SOFTWARE TRANSFER. You may transfer the Software from one PC to another, provided that the Software is used only on one single PC. You may not distribute copies of the Software, or of accompanying material to third parties. You may not transfer the Software to third parties without a previous written permission of AERN. You may not resell or transfer the Software in any other way by no consideration. You may not rent or let the Software either. 8.- AUTHORIZED SOFTWARE UPDATES. AERN may offer to clients updates of the Software. AERN reserves the right to demand additional payments for these updates. The client may, of course, reject such updates. You may use the updated product only in conformity with the permissions of this EULA. 9.- TERMINATION OF EULA. Without prejudice to any other rights, AERN may terminate this EULA if you fail to comply to the terms and conditions of this EULA. In this case, you must return or destroy all copies of the Software, including all modified copies, if there exist any, and component parts. LIMITED WARRANTY In no case AERN will be liable for any incidental damages, direct or indirect (including, without limitations, the damages for losses of business profits, business interruption, loss of business information or any other pecuniary loss) arising out of the use or the incapacity to use this Software, or the disposition or lack of support services, even if the company has been informed of the possibility of such damanges. The liability of AERN for all terms of this licence shall be limited to the amount paid by the customer for the Software. The warranty indicated above is not applicable to any medium that has been damaged as result of an accident, bad use, abuse or as result of the service or modification by any other party than AERN. AERN disclaim any warranty, implicit or explicit, in a written or oral way, with regard to the Software, the data and the documentation, especially the warranty related to the use with a certain objective. The Software and the related material are covered by a warranty limited to 90 days. Some Software versions include the possibility of downloading data automatically or through the Internet or other systems. AERN includes this possibility in order to facilitate the usefulness of its Software. AERN is not liable for the correction of market data downloaded in this way. AERN is not a supplier of market data. Therefore, it does not accept reclamations that are caused by the working of the automatic data download, of the correction of such data or of the incorporation of them in the system. AERN may decide at any time to eliminate automatic downloading systems and/or implement new systems. AERN may even eliminate the data downloading system. The liability for the data provided for the software lies exclusively with the user.
