License Agreement for SterJo StartUp Monitor PRO v.2.08 IMPORTANT: YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT AND THE LIMITATIONS OF YOUR LICENSE BY INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE USING THE SOFTWARE. IF YOU DO NOT AGREE, DO NOT INSTALL, DISTRIBUTE OR USE THE SOFTWARE IN ANY WAYS. 1. Definition "Software" means SterJo StartUp Monitor PRO version 2.0 and any related updates supplied by SterJo Software. 2. Trial Period License You may download and use the Software for free for thirty (30) days after installation ("Trial Period"). During the Trial Period, SterJo Software grants you a limited, non-exclusive license to copy and use the Software for evaluation purposes and only for internal use. 3. License After Trial Period All users have the option during the Trial Period of paying a license fee in order to be able to use the Software after expiration of the Trial Period. The Software is available as a single user license. Single user licenses require each copy of the software to be registered individually. If you do not pay the license fee before the Trial Period expires, the present License will be immediately terminated and you lose any right to the Software. 4. Restrictions 4.1. You may not provide or make available by any means the License Key to any third party. You undertake to take such steps as are necessary in order to protect the License Key against unauthorized use. Should a multiple use of the License Key be detected, SterJo Software is entitled to damages for the prejudice suffered and may terminate your use of the Software without any compensation. 4.2. Except from the authorized copy for backup purposes, you may not make additional copies of the Software, nor distribute them. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form. You may not modify, adapt, translate the Software or any parts thereof, or create derivative works based on the Software. You may not sell, rent, lease, sublicense, transfer, resell for profit or otherwise distribute the Software or any part thereof. 5. Ownership and Intellectual Property Rights This Agreement gives you limited rights to use the Software. SterJo Software retain any and all rights, title and interest in and to the Software and all copies thereof, including copyrights, patents, trade secret rights, trademarks and other intellectual property rights. All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by SterJo Software. 6. No Refund Because the Software is provided free of charge during the Trial Period to allow potential customers to evaluate and test it before paying the license fee, SterJo Software enforces a strict no-refund policy. Please evaluate and test the Software carefully during the Trial Period. Once you pay the license fee, your payment is final and you may not be reimbursed. 7. Maintenance, support and updates SterJo Software is under no obligation to maintain, support or update software in any way, or to provide updates or error corrections. However, if you have purchased technical support from SterJo Software for this product will SterJo Software then provide technical assistance according to the terms of the contract. 8. Limitation of Liability THE SOFTWARE IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE AT YOUR OWN RISK. THE AUTHOR WILL NOT BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE. 9. Distributing Trial version of software may be freely distributed provided that it is not modified in any ways and that the original distribution packages remain intact with all accompanying files, and provided that no fee is charged (except for any reasonable fees necessary to cover costs of distribution media), and that this license agreement is not violated in any ways. You are allowed to include the software to any commercial CD-ROM or DVD software collection without a written permission from SterJo Software. SterJo Software reserves the right to deny you from distributing the software even if you haven’t violated this license agreement. 10. Reservation of Rights SterJo Software reserves all rights not expressly granted to you in this license agreement.
