End User License Agreement for TSW SiteSync Important! Read carefully. This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Tanggaard Software for the product TSW SiteSync, which includes computer software and digital documentation. BY INSTALLING, COPYING, OR OTHERWISE USING THIS PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, COPY, OR USE THE PRODUCT. 1. Definitions 1.1 The software TSW SiteSync and all digital documentation that is included. 1.2 Licensed user A user of the software, who has bought the software and uses it according this EULA. 1.3 The service The support that Tanggaard Software provides to licensed users of the software 1.4 Evaluation version A shareware version of the software that can be used, for evaluation purposes only, during a limited period of 30 days. 2. Copyright 2.1 The software is copyright protected. All rights, title, and copyrights on TSW SiteSync are owned by Tanggaard Software or one of its licensors. 2.2 Multiplying You are free to distribute exact copies of the software to anyone. You are prohibited from selling, or requesting donations, for any copies of the software you distribute. You must include a copy of this license with any copy of the software. You may not remove or alter any identification, proprietary notice, label, or trademark which appear on or in the software. 3 Grant of License 3.1 Evaluation Terms and Conditions. You may use this software solely for evaluation purposes without charge for a period of thirty (30) days. 3.2 Full License Terms and Conditions. If you continue to use the software after the thirty (30) runs of evaluation period, you are obliged to purchase a license. After you have registered, you may personally use the software on a maximum of two computers. 4 Restrictions 3.1 The information contained in the software is confidential and owned by Tanggaard Software or it its licensors. Tanggaard Software and its licensors retain title to all copyright, patent, trademarks, trade secrets, and other proprietary rights embodied in or related to the software. 3.2 The software may not be modified. You are not allowed to decompile, disassemble or otherwise attempt to access the source code of the software; except and only to the extent permitted applicable law notwithstanding this limitation. 3.3 Licensee may not rent or lease the software. 5 Software transfer You may permanently transfer all of your rights under this EULA, provided you will transfer the complete software, and the recipient agrees to the terms of this EULA. 6 Termination Without prejudice to any other rights, Tanggaard Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the software. 7 Service 7.1 Updates or maintenance Tanggaard Software has no obligation to provide upgrades or maintenance releases of the software. 7.2 Support Tanggaard Software may provide support for the software as described in the documentation or on their website. Tanggaard Software reserves the right to revoke or modify support provided for the software at any time, for any or no reason. 8 Liability and Warranty 8.1 The software is provided "as is" without warranty of any kind, either express or implied, including any warranty of quality, merchantability, or fitness for a particular purpose. Tanggaard Software does not warrant that the software will meet your requirements, or that it will operate uninterrupted or error-free. 8.2 In no event will Tanggaard Software, or its licensors be liable for loss of data, costs of procurement of substitute goods or services or any special, consequential or incidental damages, under any cause of action and regardless of whether or not Tanggaard Software., or its licensors, have been advised of the possibility of such damage. This limitation will apply notwithstanding any failure of essential purpose of any limited remedy provided herein. In any event, Tanggaard Software, or its licensors' liability arising out of this agreement, the termination thereof, and/or the provision of goods or services hereunder will be limited to the maximum of USD 1 (One American Dollar). The entire risk arising out of use or performance of the software remains with you.
