Virtual Audio Cable Software Product License Agreement All exclusive rights to this Software Product remains the property of the Author, Eugene V. Muzychenko. Use of this software is allowed only upon agreement of this license. The Author (here in after refereed to as the Licensor) grants you (here in after refereed as the Licensee) a non-exclusive license to use this software in accordance with the terms of this agreement. 1. Conclusion and termination of this Agreement - The Licensee is deemed to have concluded this agreement when the Licensee copies part or the whole of this software, or when the Licensee starts to use the program included in this software. Here, use of the program refers to executing the program executable files on a PC. - This agreement may be terminated by the Licensee at any time. - All instances of this software shall be erased upon termination of this agreement. 2. Rights and obligations - Feature-limited FREEWARE (lite) version of this software can be used only in a private home environment that is not associated with income generation. - TRIAL version of this software can be used anywhere to evaluate product functionality. Explicit commercial usage is prohibited. - FULL version acquired under the HOME license can be used only in a private home environment that is not associated with income generation. - FULL version acquired under the BUSINESS license is permitted for any kind of commercial usage. - Each copy of the FULL version can be distributed only together with its lawfully obtained license. - Audio Repeater application included in the distribution package, can be used freely, even without installing entire VAC Product. - The Licensee is permitted to distribute FREEWARE (lite) or TRIAL versions of this software in accordance with the following terms: (1) The Licensee cannot modify content and structure of this software. However, the Licensee may compress/archive this software if it can be unpacked using commonly used methods. (2) The Licensee cannot profit from provision of this software to third parties. However, TRIAL version of this software can be freely distributed together with another product, including commercial ones. - For the FULL version, a lawfully obtained software copy can be used in accordance with the following terms: (1) one HOME license covers product installations and running instances on all computers inside the same home; (2) one BUSINESS license covers a single running instance, either on a real or virtual machine. Thus, number of instances running at the same time must not exceed number of licenses acquired. The "running instance" means VAC driver that transfers audio streams through Virtual Cables. If there are no active streams (Virtual Cable devices are not used), there are no running instances in the system. Copies of FULL version distribution package can be made for backup purposes only. License transfer rights: - The owner of a lawfully purchased license(s) to the FULL version is permitted to transfer (not to replicate) it (them) to a third party (parties). In such case, the third party becomes a new Licensee, and must accept this Agreement. - If the Licensee transfers the last of previously acquired license, the he/she loses all rights to the FULL version, ceases to be a Licensee, and cannot retain any copies of the FULL version. - For a license pack (a volume) purchased at once with a discount, individual licenses or license subsets can be tranfserred separately only from a pack of 50 licenses or less. A pack of 51 or more licenses can be transferred only as a whole. A separate agreement is required to resell larger license packs for parts. 3. Support policy The Licensor provides TECHNICAL support for the Software Product. The "technical support" term means analysing technical details of Product functionality in a particular computer environment, and solving related technical problems. Technical support is provided free of charge for all cases when the Product works not as described in the documentation, within one year from the date of purchase of the Product license. Technical support does not assume training in Product usage (sole or together with three-party software), operating system or general computer usage. The user should consult the documentation before asking for support. Support requests can be written in English or Russian. Requests can be processed up to 3 business days. For user requests not related to incorrect Product functioning and/or issued after one-year period, additional processing time and/or payment may be required. Upgrades/downgrades within the same major product version (the first number of the numeric version representation) are provided freely within three years from the date of purchase of the Product license. 4. Refund policy Refunds are possible only if ALL conditions listed below are met: - The software is installed and used exactly as described. - The software works not as described and some of its key features listed in the documentation are not supported. - There is no workaround to make the software working properly. 5. Liability This software is distributed "as is". The Licensor does his best to ensure reliable and safe operation of his software, but no warranty of any kind is expressed or implied. You use the software at your own risk. The Licensor will not be liable for data loss, damages, loss of profits or any other kind of loss while using or misusing this software. In any case, the Licensor's liability may not exceed the amount paid by the Licensee. Version from June 19, 2020.
