VistaMetrix, hereinafter referred to as "the Software", is protected by United States copyright laws and international treaty provisions. Portions of the Software were created using LEADTOOLS, a product of Lead Technologies, Inc. Title, ownership rights, and intellectual property rights in and to the Software, with the exception of the portion created using LEADTOOLS, remain with SkillCrest, LLC, hereinafter termed "SkillCrest". Title, ownership rights, and intellectual property rights in and to the portion of the Software created using LEADTOOLS remain with Lead Technologies, Inc. The software is provided in both evaluation and licensed versions. The evaluation version is limited in the number of times that it may be used. The licensed version permits unlimited use. You are permitted to copy the evaluation version and distribute it to other persons as long as it is not modified. The licensed version of the Software is licensed to you solely for your personal use on a single computer. You must first uninstall the licensed version of the Software from one computer before installing it on another computer. You may make one copy of the licensed version of the Software for backup purposes. You may not make copies of the licensed version of the Software for distribution to other people or organizations. The structure, organization, and source code of the Software are valuable trade secrets of SkillCrest. You agree not to decompile, disassemble, modify, reverse assemble, reverse engineer, or reduce to human readable form the Software or any part thereof or create any derivative works based on this Software. The Software is provided "as is" with no express or implied warranties. Under no circumstances will SkillCrest be liable for direct, indirect, special, or consequential damages arising from the use of this Software. SkillCrest makes no representations about the suitability of the Software for any particular purpose. The accuracy of the data produced through the use of the Software depends not only upon the precision inherent in this Software, but also upon the accuracy of the underlying graphical display with which it is used, and upon the accuracy with which the user aligns the features of the Software with the features of the underlying graphical display. You will assure that your use of the Software with other applications and images does not infringe on the copyrights of those applications or images. You further agree to indemnify SkillCrest against any claims or actions for copyright infringement arising from such use. Such use could include copying of that image as well as extraction and use of data from that image. Legal consultation with an attorney competent in copyright law is recommended. The Software may be subject to export controls under the laws and regulations of the United States. You certify that you are entitled to receive the Software In accordance with those export control laws and regulations. You further certify that you will not export, transfer, or provide access to any of the Software to any person, country, or other entity to whom such export, transfer, or access is prohibited by those export control laws and regulations. This agreement shall be construed, interpreted and governed by the laws of the State of Arizona.
