End User Legal Agreement This is a legal agreement between you and Sibsoft (www.sibsoft.net), covering your use of any Sibsoft products (the "Software"). Be sure to read the following agreement before purchasing or using the Software. LICENSE Sibsoft grants you a non-exclusive license to use the Software on one installation to be accessable by one URL (web address) subject to the provisions in all sections of this Agreement. The Software is licensed only to you. You may not rent, lease, sublicence, sell, assign, pledge, transfer or otherwise dispose of the Software in any form, on a temporary or permanent basis, without the prior written consent of Sibsoft. REQUIREMENTS The Client is responsible for ensuring that the server onto which the Licensed Software is installed meet the minimal requirements prescribed from time to time by Sibsoft. At no time will Sibsoft make refunds of any kind, for any reason. It is your responsibility to make sure you can meet the requirements of the script before you purchase. OWNERSHIP AND LIMITS TO USE 1. Purchasing this software allows you the right to use it on a single public website. 2. You may install the Software on behalf of a third party subject to their agreeing to be bound by the terms of this license but you may not re-distribute, sell, rent or lease the Software to others. You may make modifications to the software but the original license agreement will remain in force for the modified version. MODIFICATIONS TO THE LICENSED SOFTWARE The Client may modify, adapt, and create improvements to the Licensed Software as it deems appropriate pursuant to the following conditions and limitations: 1. Any code developed by Sibsoft may not be used in products outside of or unrelated to the Licensed Software. Sibsoft retains full ownership rights to the code they developed, and only allow its use within the Licensed Software. 2. Sibsoft is not liable for any custom modifications you do. By making modifications to the Licensed Software, you waive any support rights which you may have been entitled to before making such changes. TERMINATION This Agreement will terminate automatically upon failure to comply with the limitations described herein. On termination, you must destroy all copies of the Software. Termination of the license due to noncompliance will not result in any refunds of license fees. REFUND POLICY No refund will be give once Software will be download and/or license key will be generated. If you purchased Software by mistake - contact Sibsoft immediately, prior downloading Software. Failing to do so will lead cancelling right to a refund. DISCLAIMER OF WARRANTY The Software and its related documentation are provided "AS IS" and without warranty of any kind and Sibsoft expressly disclaims all other warranties, expressed or implied, including,but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Under no circumstances shall Sibsoft be liable for any incidental, special, or consequential damages that result from the use or inability to use the Software or related documentation,even if Sibsoft has been advised of the possibility of such damages. In no event shall Sibsoft liability exceed the license fee paid, if any. The Software and documentation is provided with RESTRICTED RIGHTS as described in the License Agreement.
