Any action or proceeding by either party against the other arising out of or related to this agreement shall be brought only in a state or federal court of competent jurisdiction located in Dekalb, Georgia, USA. The parties hereby consent to in persona jurisdiction of said courts. Warranty: This program is provided "as is" without warranty of any kind, either expressed or implied, including any warranty of merchantability or fitness for a particular purpose. In no event shall Blue Elephant Software be held liable for any loss of profit, special, incidental, consequential, or other similar claims.
